Potrivit legisla\u021biei \u00een vigoare, asocia\u021biile de proprietari nu sunt ocolite de obliga\u021bia de a respecta Regulamentul european privind protec\u021bia datelor (GDPR) \u0219i nici de controalele Autorit\u0103\u021bii de Protec\u021bia Datelor (ANSPDCP). De aceea, to\u021bi cei interesa\u021bi de anun\u021buri imobiliare, care vizeaz\u0103 locuin\u021be la bloc<\/u><\/span><\/a>, trebuie s\u0103 \u0219tie c\u0103 asocia\u021biile nu au voie s\u0103 le cear\u0103 copii ale actelor de identitate sau ale altor documente cu date personale pentru cartea de imobil. Cu alte cuvinte, asocia\u021biile trebuie s\u0103 aplice principiul prelucr\u0103rii a c\u00e2t mai pu\u021bine date, strict necesare. \u00cen ghidul publicat pentru asocia\u021biile de proprietari<\/u><\/span><\/a>, ANSPDCP a subliniat c\u0103 asocia\u021biile nu ar trebui s\u0103 cear\u0103 copii dup\u0103 diverse documente ale celor care locuiesc la bloc.<\/p>\n

Protec\u021bia datelor trebuie respectat\u0103<\/b><\/p>\n

ANSPDCP men\u021bioneaz\u0103: \u201e\u00cen ceea ce prive\u0219te \u00eenscrierea persoanelor \u00een cartea de imobil, art. 94 din Norme prevede c\u0103 aceasta se face \u00een baza actului de identitate, iar pentru copiii sub 14 ani, \u00een baza certificatului de na\u015ftere. Pentru \u00eenscrierea persoanelor \u00een cartea de imobil nu pot fi solicitate fotocopii ale actelor de identitate, certificatelor de stare civil\u0103 sau titlurilor de proprietate, normele stabilind c\u0103 acestea pot fi doar verificate vizual pentru conformitate.\u201d Este vorba despre Normele metodologice de aplicare unitar\u0103 a dispozi\u0163iilor Ordonan\u0163ei de urgen\u0163\u0103 a Guvernului nr. 97\/2005 privind eviden\u0163a, domiciliul, re\u015fedin\u0163a \u015fi actele de identitate ale cet\u0103\u0163enilor rom\u00e2ni.<\/p>\n

GDPR-ul impune tuturor celor ce prelucreaz\u0103 date s\u0103 respecte c\u00e2teva principii de baz\u0103, printre care:<\/p>\n

-datele trebuie s\u0103 fie prelucrate \u00een mod legal, echitabil \u0219i transparent fa\u021b\u0103 de persoana vizat\u0103;<\/p>\n

-datele prelucrate sunt adecvate, relevante \u0219i limitate la ceea ce este necesar \u00een raport cu scopurile \u00een care sunt prelucrate (reducerea la minimum a datelor).<\/p>\n

Cele dou\u0103 principii trebuie avute \u00een vedere \u0219i de asocia\u021biile de proprietari. Astfel c\u0103 a le solicita celor care locuiesc \u00een bloc anumite copii dup\u0103 documente \u0219i diverse informa\u021bii (profesia, de exemplu, care \u00een mod definitiv poate fi considerat\u0103 chiar irelevant\u0103 \u00eentr-un atare context) poate fi considerat excesiv pe legisla\u021bia de protec\u021bia datelor. Mai mult dec\u00e2t at\u00e2t, solicitarea unor copii ale documentelor se traduce prin prelucrarea de date personale. Iar asta presupune, conform Legii nr. 190\/2018, ca asocia\u021bia s\u0103 aib\u0103 angajat un responsabil cu protec\u021bia datelor.<\/p>\n

Administratorii trebuie s\u0103 fie califica\u021bi<\/b><\/p>\n

O alt\u0103 neregul\u0103 practicat\u0103 \u00eenc\u0103, de\u0219i \u00een afara legii, este aceea de a se numi administratori ai asocia\u021biilor de proprietari f\u0103r\u0103 ca ace\u0219tia s\u0103 fie califica\u021bi \u00een domeniu. Or, \u00eencep\u00e2nd cu 1 ianuarie 2022, \u00a0administratorii de bloc trebuie s\u0103 de\u021bin\u0103 un certificat de calificare profesional\u0103 pentru a-\u015fi p\u0103stra func\u0163iile. Termenul anterior a fost prelungit la sf\u00e2r\u0219itul lui 2020. Legea nr. 294\/2020<\/u><\/span><\/a> prevede c\u0103 administratorii de bloc au putut ob\u0163ine certificatul de calificare profesional\u0103 p\u00e2n\u0103 la data de 1 ianuarie 2022, pentru a putea s\u0103 \u00ee\u015fi p\u0103streze func\u0163iile, conform noii legisla\u0163ii privind asocia\u0163iile de proprietari. Anterior, termenul-limit\u0103 pentru ob\u0163inerea acestui certificat era prev\u0103zut de Legea nr. 196\/2016 ca fiind 28 septembrie 2019, \u00eens\u0103 Guvernul a decis, \u00een luna august din 2019, prelungirea p\u00e2n\u0103 la 1 ianuarie 2021.<\/p>\n

Potrivit Legii 196\/2018<\/u><\/span><\/a> privind \u00eenfiin\u021barea, organizarea \u0219i func\u021bionarea asocia\u021biilor de proprietari \u0219i administrarea condominiilor, certificatul de calificare profesional\u0103 reprezint\u0103 actul care dovede\u0219te calificarea profesional\u0103 a persoanelor fizice pentru a fi administratori de bloc. \u00cen esen\u021b\u0103, pot fi atestate de primarul localit\u0103\u021bii pentru a \u00eendeplini ocupa\u021bia de administrator de bloc doar persoanele care de\u021bin un certificat de calificare.<\/p>\n

Anterior apari\u021biei actualei legi a asocia\u021biilor, administratorii de bloc aveau o singur\u0103 obliga\u021bie, \u0219i anume s\u0103 fie atesta\u021bi de c\u0103tre primar, nu s\u0103 de\u021bin\u0103 \u0219i un certificat de calificare profesional\u0103.<\/p>\n","protected":false},"excerpt":{"rendered":"
